New CPSIA Mandates
The U.S. Government has recently and dramatically changed its compliance requirements for product manufacturers and importers. All recent CPSC Settlement Agreements required the companies to “implement and maintain a compliance program” that “ensures compliance with the safety statutes and regulations enforced by the CPSC.” The compliance program implemented by the companies would be open to auditing by the CPSC to ensure the ‘proof-of compliance’ and training requirements. The CPSC not only expects companies to have effective programs in place, but also to be able to properly document those processes. Companies are now at risk for massive fines if they are unable to prove ‘due care’ according to the following requirements:
- Proof of written compliance standards and policies;
- Retention of all compliance-related records for a minimum of five years;
- Assignment of a senior-level compliance manager/officer;
- A confidential and operational process for employees to be able to report compliance related questions or issues to a compliance manager/officer; and
- Training on company compliance-related policies and procedures for all applicable employees, including the company’s Board of Directors if applicable.*
